These Terms of Use ("Terms") are an agreement between you and Smithi ("we", "us") and govern your use of Smithi's services and website at smithi.ai. By accessing or using Smithi, you agree to these Terms. If you do not agree, do not use Smithi.
Using Smithi
You may use Smithi only as permitted by these Terms and applicable law. When you use Smithi, you agree to:
- Provide accurate information and keep your account secure
- Use Smithi only for lawful, professional real estate purposes
- Only submit client or third-party information you are authorized to share
- Do not scrape, overload, probe, or reverse-engineer the service
- Do not use Smithi to send unlawful, deceptive, or discriminatory content
Professional use and your responsibilities
Smithi supports licensed real estate professionals. Smithi prepares and routes work, and a licensed agent reviews and approves it before anything is sent or filed. You remain responsible for the work, for supervising it, and for compliance with the laws and professional rules that apply to you.
Smithi is not a party to any real estate transaction and does not provide legal, tax, brokerage, or appraisal advice. Nothing Smithi produces is a substitute for professional judgment.
Ownership
Our content
Smithi, including the service, the website, and their content and branding, belongs to Smithi. Third-party names and logos belong to their respective owners.
Your data
The information you and your clients provide remains yours. You grant Smithi the rights needed to process it to provide the service, as described in our Privacy Policy.
Third-party services
Smithi works with third-party service providers and may link to third-party sites. Those services are governed by their own terms and privacy policies, and we are not responsible for them. Your use of a connected service is between you and that provider.
No warranties
Smithi is provided "as is" and "as available", without warranties of any kind, whether express or implied. We do not warrant that the service will be uninterrupted or error-free, or that any draft, valuation, estimate, or other output is accurate or fit for a particular purpose. Any figures or demonstrations are illustrative.
Limitation of liability
To the fullest extent permitted by law, Smithi will not be liable for any indirect, incidental, special, or consequential damages, or for any loss of profits, data, or goodwill, arising from your use of Smithi. You are responsible for your use of the service and for the content and instructions you submit.
Governing law and changes
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules.
We may update these Terms from time to time. When we do, we will change the "Last updated" date at the top of this page. Continued use of Smithi after a change means you accept the updated Terms.
